Brisbane company director fined and disqualified

Brisbane director, Brian David Leah, has been convicted and fined $1,500 for lodging a false document with ASIC.

Mr Leah pleaded guilty in the Pine Rivers Magistrates Court on Friday 17 April 2015 and was convicted and fined $1,500.

As a result of the conviction, Mr Leah has also been automatically disqualified from managing companies for five years.

Mr Leah was the director of Deck Rite Australia Pty Ltd, a Queensland-licenced building and construction company.

ASIC’s investigation found that in September 2012, Mr Leah lodged a form with ASIC to voluntarily deregister Deck Rite Australia Pty Ltd and falsely declared that the company was not involved in any legal proceedings even though at the time, Mr Leah was aware that Deck Rite Australia Pty Ltd was the plaintiff in an ongoing legal proceeding in relation to a dispute with a client.

ASIC Commissioner Greg Tanzer said, ‘The integrity of ASIC’s corporate register relies on directors providing complete, accurate and honest information. Individuals that lodge false information with ASIC, will be pursued in the courts.’

The matter was prosecuted by the Commonwealth Director of Public Prosecutions.
