FOI disclosure log

ASIC is required to publish all documents released under the FOI Act, within 10 working days of the applicant being given access to the documents (s11C(6)).

This requirement applies to information released in response to FOI requests received after 1 May 2011.

Publication may be by way of making the information released available for download from ASIC’s website (s11C(3)(a)) or by publishing details of how the information may be obtained from ASIC (s11C(3)(c)).  

What is included in the log

ASIC's disclosure log lists all FOI request releases to which the publication obligation applies.

Documents released in response to an FOI request that are subject to the exceptions below are not required to be placed on the disclosure log. 

What is not included in the log

Documents containing the following are exempt from inclusion in the disclosure log:

  • personal information about any person if publication would be unreasonable (s11C (1)(a));
  • information about the business, commercial, financial or professional affairs of any person if it would be unreasonable to publish that information (s11C(1)(b)) ;
  • information determined by the Australian Information Commissioner not to be disclosed (s11C(1)(c) and 11C(2)); or
  • any information if it is not reasonably practicable to publish the information because of the required deletions to the document (s11C(1)(d)).

Charges

A charge may be imposed to reimburse ASIC for the cost incurred in copying or reproducing the information or sending it to you.

You will be notified if any charge is payable and required to pay the charge before the information is provided.

Charges will be calculated on the following basis:

Photocopying 10 cents per page
Postage at cost
Magnetic media
(eg, a CD or DVD)
at cost
