02/464 Former SA insurance agent permanently banned

The Australian Securities and Investments Commission (ASIC) has permanently banned Ms Janice Lee Lewinski, of Seacombe Heights, South Australia, from providing any financial services.

The banning order was made following ASIC's investigation into Ms Lewinski’s conduct as an insurance agent.

ASIC alleges that between 16 November 1995 and 13 March 2002, whilst Ms Lewinski was the sole proprietor of Harrerds Insurance Agencies, she received insurance premiums from clients under proposed contracts of insurance, but did not pass this money on to the insurance companies.

ASIC formed the view that as a consequence of her alleged conduct, there is reason to believe Ms Lewinski will not comply with any financial services law, and took action to prohibit her from the industry.

Ms Lewinski is currently facing 10 charges under the Insurance (Agents and Brokers) Act by ASIC in relation to the allegations that she failed to pass on premiums to insurance companies.
