AD08-69 PDS notifications to be lodged electronically from 1 January 2009

From 1 January 2009, notifications to ASIC about a Product Disclosure Statement (PDS) will need to be made online.

This is a result of a change to section 1015D of the Corporations Act 2001 which was introduced by the Corporations Legislation Amendment (Simpler Regulatory System) Act 2007 and affects the use of:

  • Form FS88 PDS in-use notice

  • Form FS89 Notice of change to fees and charges in a PDS

  • Form FS90 Notice that a product in a PDS has ceased to be available

These forms will be made available on ASIC’s existing online portals:

  • Australian financial service licensee portal;

  • Company officeholder portal; and

  • Registered agent portal.

Previous PDS notifications that have been lodged with ASIC will be able to be viewed online.

ASIC is committed to providing accessible online lodgement services to assist business. In particular, further changes are anticipated to facilitate online applications for managed investments scheme registration.
