16-396MR ASIC charges former company director with fraud

Mr Shane Douglas Heal, of Kangaroo Point, New South Wales today appeared in the Brisbane Magistrates Court charged with three counts of fraud under the Criminal Code (Queensland).

ASIC alleges Mr Heal, in:

  • 2008, dishonestly gained a benefit of $250,000 from an investor for Shyfox Pty Ltd (Shyfox), and
  • 2009, dishonestly gained a benefit of $250,000 from an investor for Cre8ive Constructions Queensland Pty Ltd (Cre8ive Constructions), and
  • 2010, dishonestly gained a benefit of $250,000 from an investor for 23 Investments Pty Ltd (23 Investments). 

At the time of the alleged conduct, Mr Heal was the sole director of Shyfox, Cre8ive Constructions and 23 Investments, and the charges were brought against Mr Heal following an ASIC investigation into his conduct as the director of those companies.

Mr Heal did not enter a plea.

The matter was adjourned for further mention.  Mr Heal has entered into bail to appear at the Brisbane Magistrates Court at 9:00am on 16 December 2016.

The Commonwealth Director of Public Prosecutions is prosecuting the matter.

Background

Mr Heal has been charged with three counts of fraud under section 408C(1)(d) of the Criminal Code (Queensland) 1899.

A Receiver was appointed to Shyfox on 7 January 2012 and the company was subsequently deregistered on 26 April 2013.

Cre8ive Constructions was deregistered on 3 February 2014.

A liquidator was appointed to 23 Investments on 2 March 2012 and the company was subsequently deregistered on 13 October 2013.

Following a hearing at the Brisbane Magistrates Court on 16 December 2016, the matter was adjourned for further mention on 27 January 2017.

At a mention on 27 January 2017, the matter was set down for a contested committal hearing on 26 and 29 May 2017.

The committal proceedings were part heard on 26 and 29 May 2017 and have been adjourned until 20 July 2017.

Editor's note 4:

On 20 July 2017, Mr Heal was committed to stand trial on all three counts of fraud. The trial is scheduled for a date to be fixed.
