Cairns director charged with making a false statement to ASIC

Andrew Ross Eddy of Cairns, QLD, has been charged with making a false or misleading statement to ASIC.

Following an ASIC investigation, it is alleged that in June 2020, Mr Eddy, the sole director of East Coast Construction Services Pty Ltd (ACN 126 575 826), made a false or misleading statement on a form lodged with ASIC to voluntarily deregister East Coast.

ASIC alleges that Mr Eddy falsely declared that East Coast was not a party to any legal proceedings at the time of lodging the form. It is alleged that East Coast was a party to legal proceedings in the Queensland Civil and Administrative Tribunal at the time.

East Coast operated in the building and construction industry.

Mr Eddy appeared in the Cairns Magistrates Court on 8 February 2022. The matter has been adjourned until 8 March 2022 for further mention.

The matter is being prosecuted by the Commonwealth Director of Public Prosecutions following a referral from ASIC.

Background

Making a false or misleading statement to ASIC is a breach of s1308 of the Corporations Act and carries a maximum penalty of five years imprisonment.
