Tatiana De Oliveira, also known as Tatiano De Oliveira, of Byron Bay, New South Wales, has been charged with making a false or misleading statement to ASIC.

Between 8 June 2018 to 21 August 2020, Mr De Oliveira was the sole director of Shiera Wellbeing Centre Pty Ltd (ACN 626 309 939), a Brisbane-based business that provided alternative and holistic health and beauty services.

ASIC alleges that on 12 May 2020 Mr De Oliveira made a false statement on a form lodged with ASIC to voluntarily deregister Shiera Wellbeing Centre.

ASIC alleges that Mr De Oliveira falsely declared in the form that Shiera Wellbeing Centre had no outstanding debts.  It is alleged that Shiera Wellbeing Centre had an outstanding debt following an order made by the Queensland Civil and Administrative Tribunal.

Mr De Oliveira appeared in the Bryon Bay Local Court on 8 August 2022. The matter was adjourned until 22 August 2022 for mention.

The matter is being prosecuted by the Commonwealth Director of Public Prosecutions following a referral from ASIC.

Background

Making a false or misleading statement to ASIC is a breach of s1308 of the Corporations Act 2001 (Cth) and carries a maximum penalty of five years imprisonment.

On 22 August 2022, Mr De Oliveira pleaded guilty to the lesser offence of not taking all reasonable steps to ensure the document was not materially false or misleading because of the statement or omission, s1308(3)(d) of the Corporations Act. The offence carries the maximum penalty of 20 penalty units.  

The matter has been adjourned until 12 September 2022 for sentencing at Byron Bay Local Court.
