Brett Paul Trevillian pleads guilty to making false documents

Metal Alpha Pty Ltd director Brett Paul Trevillian has pleaded guilty to forging portfolio performance verification reports when he was the investment manager of AlphaThorn Pty Ltd.

Between April 2019 and October 2019 Mr Trevillian created four forged portfolio performance verification reports relating to two investment products offered by AlphaThorn, the Secured service product and the Enhanced service product.  AlphaThorn intended to provide these reports to potential investors. The forged reports falsely verified or claimed a history of investment returns by AlphaThorn.

On 7 May 2024 at the Downing Centre Local Court Mr Trevillian pleaded guilty to two offences of making a false document with the intention to obtain a financial advantage, one offence in respect to reports relating to the Secured service product and one offence in respect of a report relating to the Enhanced service product.

The matter will next appear before the Sydney District Court on 7 June 2024, when a date for a sentencing hearing will be set.

The matter is being prosecuted by the Commonwealth Director of Public Prosecutions following a referral from ASIC.

Background

AlphaThorn now operates under the name Trading Life Services Pty Ltd.

Mr Trevillian was arrested by officers from the NSW Police Force on 20 July 2023 (23-201MR).

The maximum sentence for making a false document to obtain a financial advantage under section 253 of the Crimes Act 1900 (NSW) is 10 years' imprisonment.

Mr Trevillian attended the NSW District Court on 7 June 2024 and sentencing was set for 23-24 Sep 2024.

On Wednesday 25 Sep 2024 the sentencing hearing of Brett Trevillian was stood over by Judge Neilson to 6 December 2024 to enable a full sentencing assessment report to be prepared.

On 24 October, the hearing for the sentencing of Mr Trevillian was vacated. A date will now be set for sentencing in November 2024.
