Following an ASIC investigation, Mr Emre Tahsin Basar of Docklands, Victoria has been arrested and charged with eight (8) counts of dishonestly using his position as an employee to gain a financial advantage.
ASIC alleges that between 11 and 17 February 2026, Mr Basar—while employed as a desk assistant by BW Equities Pty Ltd, an equities advisory business—dishonestly used his position by trading shares held in a client's account without the client's authorisation. Mr Basar has since left BW Equities Pty Ltd.
ASIC alleges that the unauthorised share sales generated approximately $498,500. The funds were then shifted to an account held in the name of Zorlu Capital Pty Ltd, with Mr Basar the sole director, secretary and shareholder of that company.
Following his arrest, Mr Basar was granted conditional bail, including a requirement that he surrender passports, not attend international points of departure, and remain in Australia.
On 24 September 2026, Mr Basar appeared before the Melbourne Magistrates’ Court for a filing hearing. During that hearing, bail was extended and the matter listed for committal mention on 17 December 2026.
This matter is being prosecuted by the Commonwealth Director of Public Prosecutions following a referral from ASIC.
Background
The maximum penalty for each offence of dishonest use of position as a director, officer or employee (s184 of the Corporations Act 2001) is up to 15 years imprisonment and/or a fine of up to $765,000.
