Certificates of transfer for licensed trustee companies register
Licensed trustee companies provide trustee services to clients which include acting as executor of a will, trustee or under a power of attorney.
Under the provisions of Chapter 5D of the Corporations Act 2001, licensed trustee companies may seek approval from ASIC to transfer the assets and liabilities of the estates they manage to another licensed trustee company. We will only grant approval when we are satisfied that a transfer will be in the interests of the clients (when viewed as a group) of the transferring company and those of the receiving company. This is a precondition of the transfer going ahead under the Corporations Act. Our approval is called a transfer determination. Following the transfer determination, we issue a certificate of transfer.
