CP 29 Australian market licences: Australian operators

This policy proposal paper outlines ASIC’s role in, and proposed approach to, financial market regulation under the Financial Services Reform Act 2001 (FSR Act). It deals with financial markets operating in Australia, except for the overseas markets referred to in s795B(2).
It covers our approach to the following issues:
- our role in market regulation (Section A);
- what 'operate a financial market' means (Section B);
- what 'operate a financial market in Australia' means (Section C);
- exemptions from market regulation (Section D);
- obligations of Australian market licensees (Section E); and
- how to obtain an Australian market licence (Section F).
The Schedule gives examples of types of activities that will require an Australian market licence.
