Application to change the cessation date of a director

Purpose

A company or person who resigned as a director of a company may apply to ASIC to change the director’s cessation date only when:

• a Change to company details or Form 370 has been lodged to cease the person as a director on ASIC’s register, and
• the effective date has been replaced by ASIC with the lodgement date of the form that ceased the person as a director, and
• the application is made to ASIC within 56 days after the day the person stopped being a director of the company.

This form cannot be used to notify us of the cessation of a director.

If the person has not yet ceased as a director on ASIC’s register, you need to lodge a Change to company details or Form 370.

If outside this timeframe, the applicant will need to apply to the court to change your cessation date.
