Reviewing Liquidator Panel members

ASIC’s Reviewing Liquidator Panel comprises suitably qualified and experienced registered liquidators that ASIC can appoint as reviewing liquidators under section 90-23 of Schedule 2 of the Corporations Act 2001.

Reviewing liquidator’s powers include the power to:

  • interview the external administrator and his/her staff
  • direct any of the parties that he/she has the power to interview to give a written statement about a specified matter
  • direct the external administrator to produce specified books relating to the external administration.

ASIC may appoint a reviewing liquidator:

  • on our own initiative
  • on application by a person with a financial interest in the external administration of the company, or
  • on the application of an officer of the company.

Insolvency reforms commence on 1 January 2021

Reforms to corporate insolvency laws commence on 1 January 2021 for companies with liabilities less than $1 million.  These reforms include:

-a new debt restructuring process for incorporated businesses

-a new, simplified liquidation pathway for small businesses, and

-a new class of registered liquidator who can only undertake the debt restructuring process.
