Schedule 2 Committee referrals and decisions

Under s40-50 of Schedule 2 to the Corporations Act 2001 ASIC may refer a registered liquidator to a disciplinary committee.

The table below sets out the referrals made by ASIC to a disciplinary committee since 1 March 2017 (when this disciplinary regime started), and the results of those referrals where the committee has decided ASIC should publish information about the committee’s decision.

Katherine Elizabeth BARNET	10 July 2020	Referral to Committee – Katherine Barnet	13 November 2020	Ms Katherine Barnet continues to be registered as a liquidator as the Committee was not satisfied that her actions warranted disciplinary action and found that no other disciplinary action should be taken against her. The liquidator’s registration details are available by conducting a search on ASIC’s Register. The Committee did not make an order under s40-55(1)(h) of Schedule 2 to the Corporations Act 2001 (Cth) that ASIC should publish the reasons for the decision.
William John FLETCHER	10 July 2020	Referral to Committee – William Fletcher	13 November 2020	Mr William Fletcher continues to be registered as a liquidator as the Committee was not satisfied that his actions warranted disciplinary action and found that no other disciplinary action should be taken against him. David Nicholas IANNUZZI	31 May 2019	Referral to Committee – David Nicholas Iannuzzi	12 November 2019	David Nicholas Iannuzzi’s liquidator registration was cancelled by ASIC on 12 November 2019 following ASIC’s receipt of sealed orders made by the Federal Court on 7 November 2019 in the matter of Commissioner of Taxation v Iannuzzi (No 2) [2019] FCA 1818. As a result of the cancellation the Committee is not able to make a decision on ASIC’s referral and will not consider the matter.
