Working with other agencies and organisations – Memoranda of Understanding
ASIC has entered into memoranda of understanding (MOUs) with various other domestic agencies to assist us to efficiently and effectively carry out our functions and duties and exercise our powers. These MOUs facilitate (as applicable for each other agency or organisation) liaison, cooperation, assistance, joint enquiries or investigations, referral of matters and the exchange of confidential data and information.
Below is a list of other agencies and organisations with whom we have entered into a MOU, including a brief description and link to the MOU where available.
The ACCC's primary responsibility is to ensure that individuals and businesses comply with the Commonwealth competition, fair trading and consumer protection laws. A Memorandum of Understanding with the ACCC covering liaison, cooperation, assistance, joint enquiries and exchange of confidential information arrangements was signed on 21 December 2004.

The Australian Energy Market Operator operates Australia's electricity and gas markets.
ASIC is responsible for overseeing activities that involve financial services for exchange traded energy derivatives (electricity and gas) and the financial markets that trade them. We signed a Memorandum of Understanding with the Australian Energy Market Operator on 30 October 2012.

The Australian Energy Regulator regulates wholesale and retail energy markets (electricity and gas), and energy networks, under national energy legislation and rules.

The AFP is responsible for safeguarding Commonwealth interests and investigating serious and complex crime against the Commonwealth.

AFCA operates an independent external dispute resolution scheme that resolves complaints by consumers and small businesses about financial firms.

AFSA is responsible for the oversight of Australia's personal insolvency regime. A Memorandum of Understanding was signed by ASIC and AFSA on 16 November 2023.
APRA is responsible for ensuring financial institutions will be able to honour their commitments when they fall due. It promotes the safety and soundness of deposit-taking institutions, life and general insurance companies, and larger superannuation funds. A Memorandum of Understanding was signed by ASIC and APRA on 28 November 2019, replacing an earlier version.
ASX operates Australia’s primary national exchange for equities, derivatives and fixed interest securities.

Cboe Australia, formerly known as Chi-X, launched in October 2011. In June 2021, Cboe Global Markets, Inc., completed its acquisition of Chi-X Asia Pacific Holdings, Ltd. and its subsidiaries including Chi-X Australia Pty Ltd. Cboe operates a market in securities and managed investments with wholesale and retail participation.

The Clean Energy Regulator is responsible for administering legislation that will reduce carbon emissions and increase the use of clean energy. ASIC is responsible for overseeing activities that involve financial services for regulated emissions units and the financial markets that trade them. We signed a Memorandum of Understanding with the Clean Energy Regulator on 1 June 2012.
The CSLR is an independent not for profit organisation authorised by the Australian Government to pay compensation of up to $150,000 to eligible consumers who have an unpaid AFCA determination covering specific products and services.

The Commonwealth Director of Public Prosecutions is responsible for the prosecution of offences against Commonwealth law including all Acts administered by ASIC. Our relationship is governed by the Memorandum of Understanding with the CDPP entered into on 1 March 2006.

The FRC is a statutory body established under the Australian Securities and Investments Commission Act 2001 and is responsible for providing broad oversight of the process for setting accounting standards in Australia and giving the Minister reports and advice on that process. The FRC and ASIC signed a Memorandum of Understanding on 30 June 2004, updated on 1 May 2008.

The Council of Financial Regulators, of which ASIC is a member, has discussed developments in the Australian and international financial systems on a regular basis. In an effort to strengthen these relationships further and to improve public understanding of the responsibilities of each of the agencies, the Council members have agreed on a joint Memorandum of Understanding (MOU) dealing specifically with crisis management arrangements. The MOU reflects the strong commitment of Australia’s regulatory agencies to the open exchange of information and to a co-ordinated response to threats to the stability of Australia’s financial system.
ASIC has signed a Memorandum of Understanding (MoU) with the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA), regarding mutual assistance in the supervision and oversight of offshore oil and gas companies in Australia.
Through the MoU, ASIC and NOPSEMA express their willingness to cooperate with each other in the interest of fulfilling their respective regulatory mandates. This includes ensuring that companies in this sector comply with their obligations to remediate their sites, including appropriately accounting for these obligations in their financial reports and other regulatory documents that are under ASIC’s remit.
ASIC and NOPSEMA signed a Memorandum of Understanding on 24 May 2023.
The OAIC is an independent agency within the Attorney-General’s portfolio whose primary functions are privacy, freedom of information and government information policy. The OAIC's responsibilities include conducting investigations, reviewing decisions, handling complaints, and providing guidance and advice.
A Memorandum of Understanding was signed by ASIC and OIAC on 13 June 2024.

The RBA is responsible for monetary policy and the stability of the financial system. ASIC and the RBA signed a Memorandum of Understanding on 20 March 2002.

Standard Business Reporting offers business a quicker and easier way to lodge information with ASIC and 11 other Commonwealth and State government agencies, starting from 1 July 2010. ASIC signed the Standard Business Reporting MOU on 24 June 2010.
The Panel is a peer review body that regulates corporate control transactions in widely held Australian entities, primarily by the efficient, effective and speedy resolution of takeover disputes.
ASIC and the Panel Executive signed a new Memorandum of Understanding on 27 March 2017.
